General Terms and Conditions for Gymnasium Preparation Courses and Tutoring at LerneGerne

By registering (electronically, via email, or by phone), you acknowledge and accept the General Terms and Conditions (GTC) of “Lerne Gerne GmbH.”

Conclusion of Contract

By submitting an electronic registration (via the registration form on our website), you commit your child to participating in the course and paying the agreed course fees. Registration via the registration form constitutes a legally binding offer on your part. A contract is concluded on our part as soon as you receive a definitive course confirmation from us via email. The parties to the contract are, on the one hand, Lerne Gerne GmbH, and on the other hand, the parent or legal guardian who registers the child for the course (contract in favor of a third party).

Course Registration

A registration is only valid after a course confirmation has been sent by us via email. If you do not receive a response from us after electronic registration via the registration form, it is your responsibility to contact us again. We strive to respond as quickly as possible. There is no entitlement to course participation.

Scope of the Gymnasium Preparation Course

Our Gymnasium preparation course includes the following:

  • 40 lessons of 45 minutes in Mathematics
  • 40 lessons of 45 minutes in German
  • Regular lesson protocols
  • 1 assessment test and 1 simulation exam with personal feedback
  • Complete “YONDY” package
  • Assistance for the child with homework/questions outside course hours

Tutoring

  • You can get to know us in a non-binding lesson, which will, however, be invoiced.
  • The lesson duration can be freely chosen. The costs are as follows:
    • 45 min = CHF 93
    • 60 min = CHF 123
    • 90 min = CHF 152
  • After each lesson, you will receive a written lesson report describing the observed learning progress and how the child performed during the lesson.
  • No fixed contingents need to be booked; the workload can be adjusted at any time according to your needs.
  • You only pay for the lessons actually provided.
  • The invoice for the attended lessons will be sent to you by email at the beginning of the following month.
  • Lessons can be canceled free of charge up to 24 hours before the appointment.

Payment Terms and Default

Gymnasium Preparation Courses:

  • Instalment Payment: The course fees are paid monthly in 7 instalments, starting in the month following successful registration. The payment deadline for each instalment is 30 days. In case of late payment, a flat fee of CHF 20 with the first reminder and 40 CHF with the second reminder will be charged.
  • One-Time Payment: The invoice for the full course fees will be sent after successful registration. The payment deadline is 30 days.

Tutoring:

  • Invoicing is done monthly for the lessons actually attended.
  • The payment deadline is 30 days. In case of late payment, a flat fee of CHF 20 with the first reminder and 40 CHF with the second reminder will be charged.

Cancellation

Submitting a registration via our electronic registration form on the website constitutes a binding agreement. In the event of an erroneous registration, you must cancel your registration in writing via email to antispammail within 24 hours, providing evidence of the error.

Specific Provisions for Gymnasium Entrance Exam Preparation Courses

Cancellation fees are applied based on the time remaining before the course start date, as follows:

  • Up to 30 days before the course begins: 10% of the course fee (processing fee)

  • 29 to 14 days before the course begins: 30% of the course fee

  • 13 to 5 days before the course begins: 60% of the course fee

  • 4 days to 24 hours before the course begins: 80% of the course fee

  • No-show or cancellation less than 24 hours before course start: 100% of the course fee

  • Non-participation due to unpaid invoices: 100% of the course fee

Note: If the course commences as scheduled, the “Money-Back Guarantee after 2 Course Days” shall apply as of the first day of the course.

Money-Back Guarantee after 2 Course Days

If you are not satisfied, you may withdraw from the course within 24 hours after the second course day. In this case, the full course fee will be refunded with the exception of CHF 380.– for the personalized course material, which are non-refundable due to individual customization with the printed student’s name. The course materials cannot be returned. A written cancellation request must be submitted no later than 24 hours after the second course day.

Cancellation Due to Insufficient Participants

We reserve the right to cancel Gymnasium preparation courses up to 28 days before the start date due to an insufficient number of participants (fewer than three children per course). In this case, no course fees will be charged, and any paid course fees will be fully refunded. Alternatively, we will offer other LerneGerne courses or customized private settings.

Termination by Us

We reserve the right to terminate the contract at any time without notice and exclude your child from the course if disruptive behavior significantly affects the instructor, the course atmosphere, or other students. In such a case, there is no entitlement to a refund of course fees.

Absences from Individual Course Days

Regular attendance is crucial for the child’s success. Absences do not entitle you to a reduction in course fees.

Cancellation Due to Instructor Illness

If an instructor is temporarily unavailable due to illness, we will arrange a suitable substitute or reschedule the course. If necessary, lessons will be made up online.

Cancellation Due to Force Majeure or Governmental Order

If a course cannot be conducted in person due to force majeure or a governmental order, it will be continued online. There is no entitlement to a refund or compensation.

Liability Disclaimer

Lessons are conducted to the best of our knowledge and belief. However, we do not guarantee academic success. Lerne Gerne GmbH assumes no liability or responsibility for the academic success of participants.

Jurisdiction and Applicable Law

Swiss law applies. The place of jurisdiction is Zurich.

These GTC come into effect on 01.05.2025.
